Release of Liability Waiver and Assumption of Risk Agreement This Release of Liability Waiver and Assumption of Risk Agreement ("Agreement") is made and entered into as of

by and between DC's Sports Complex ("DC's Sports Complex"), DC's Field House ("DC's Field House") and

WHEREAS, DC's Sports Complex/ DC's Field House is facilitating the participation in activities including, but not limited to, sports cage (batting, pitching, catching), golf simulator, sports field usage, and escape room activities (collectively, the "Activities") on or after the date of this Agreement at

and** WHEREAS, Participant desires to participate in the Activity. NOW, THEREFORE, in consideration of the foregoing premises and the mutual covenants contained herein, the parties agree as follows: 1. Release and Waiver of Liability. Participant, for himself or herself, and on behalf of his or her heirs, assigns, personal representatives, and next of kin, hereby releases, waives, discharges, and covenants not to sue DC's Sports Complex, its directors, officers, employees, volunteers, agents, and lessors of premises used to conduct the Activity (collectively, "Releasees") from any and all liability, claims, demands, losses, or damages arising out of or related to Participant's participation in the Activity, including, but not limited to, personal injury, property damage, wrongful death, and illness (collectively, "Claims"). 2. Assumption of Risk. Participant acknowledges and understands that the Activity involves inherent risks, including, but not limited to, the risk of physical injury, illness, and death. Participant assumes full responsibility for any and all Claims arising out of or related to Participant's participation in the Activity. 3. Medical Authorization. Participant represents and warrants that he or she is in good health and physically fit to participate in the Activity. Participant further authorizes DC's Sports Complex to seek emergency medical treatment for Participant, and Participant agrees to be responsible for all costs associated with such treatment. 4. Minor Participant. • If Participant is under the age of 18 (eighteen), Participant's parent or legal guardian ("Parent/Guardian") must complete and sign this Agreement below. • Parent/Guardian, by signing below, represents and warrants that he or she has legal authority to enter into this Agreement on behalf of Participant. Parent/Guardian further agrees to be bound by all terms and conditions of this Agreement. 5. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania. 6. Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
